Terms of Service
Effective: October 8, 2026 · ClearProp is currently in beta.
1. What ClearProp is
ClearProp (“we”, “us”) operates an online marketplace at clearprop.imwirefree.com where sellers may list aircraft, parts, and aviation-related items and where buyers may browse and contact those sellers. We are a venue: we do not own, inspect, warrant, or take title to any item listed, and we are not a party to any transaction between buyers and sellers.
2. Eligibility
You must be at least 18 years old and legally able to enter contracts to use ClearProp’s account features. By creating an account you confirm both.
3. Your account
You are responsible for activity under your sign-in email and for keeping the email address you register reachable — account actions (including sign-in links) are delivered to it. Notify us of unauthorized use.
4. Listings
- You must own or be authorized to sell what you list; listings must be accurate, current, and located in the United States unless clearly marked otherwise.
- Prohibited: counterfeit or stolen goods, fraud, misrepresented airframes (salvage/accident history not disclosed), illegal exports, and any item whose sale violates law.
- We may remove listings we believe violate these terms, are miscategorized, or are reported and confirmed inaccurate.
- Free (Hangar) listings run for their stated duration (currently 30 days); Flight Line listings include a full 90-day run and may expire; paid features are described at checkout when billing is enabled.
5. Deals are between users
All purchases, deposits, escrow, title transfer, and closing steps happen between buyer and seller — off ClearProp’s rails unless we explicitly provide them. We strongly advise buyers to order a pre-buy inspection by a certificated A&P/IA before purchase and to verify registration and lien status through the FAA Aircraft Registry before completing any purchase. ClearProp does not guarantee any listing’s accuracy and provides no warranty, express or implied, on aircraft, parts, or services.
Anti-fraud warning: never wire money to a stranger’s account, and treat any request for off-platform payment before inspection as a red flag. See our Fraud Safety guidance (Privacy page links).
6. Fees
Listing tiers are currently free during beta. If we enable paid tiers or add-ons, we will show prices before you commit and bill through our payment processor under the processor’s terms.
7. Content license
You grant ClearProp a worldwide, non-exclusive license to host, display, and distribute the content you submit (photos, descriptions, specs) for the purpose of operating and promoting the marketplace. You keep ownership of your content.
8. Availability & changes
The service is provided “as is” during beta, without uptime guarantees. We may modify or discontinue features; material changes to these terms will be announced on the site. Continued use after changes means acceptance. Governing law and dispute process appear in section 14.
9. Buyer and seller disclaimers
Sellers: you are responsible for the accuracy of your listings. Required-disclosure items (damage history, logs status, engine/prop times, ferry or lien notes) must be answered truthfully; misrepresentation is grounds for removal and account termination. "Verified" on ClearProp means what the label says it means — FAA registry match, or human review — not a mechanical endorsement.
Buyers: no aircraft should be purchased on listing photos and text alone. Obtain an independent pre-purchase inspection by an A&P/IA near the aircraft, review complete logbooks, verify title and lien status, and fly the airplane. ClearProp provides record-context tools (registry, accidents, ADs, hours corroboration) but is not a warranty of condition, airworthiness, or title.
Estimates and valuations: financing previews, insurance bands, valuation context, ferry-cost figures, and market analytics are machine estimates from first-party data. They are not quotes, appraisals, or offers, and carry their own labels in-product.
No legal or tax advice: nothing on ClearProp is legal, tax, or investment advice.
10. Export controls (ITAR/EAR) and cross-border sales
Aircraft, engines, and avionics can be subject to U.S. export controls. The International Traffic in Arms Regulations (ITAR) covers defense articles — including many military-derived or warbird configurations — and the Export Administration Regulations (EAR) cover dual-use items. Selling or ferrying a covered item to a foreign person, or taking it out of the United States, may require authorization from the Department of State (DDTC) or Commerce (BIS) before either happens.
ClearProp automatically flags listings whose text suggests military provenance, gun-hard points, or export-restricted avionics, and shows an export-awareness notice on those records. Flags are keyword-based awareness prompts, not legal determinations — the definitive call is yours with counsel or the U.S. government.
You represent that you are not named on any applicable sanctions or denied-party list and that your transactions will comply with applicable export laws. Cross-border deals run through escrow only.
11. Taxes and payments compliance
Sales and use tax on aircraft transactions is controlled by the states where the aircraft is located or delivered. ClearProp does not collect tax on your behalf unless a future feature explicitly says so; it can surface estimated tax context, which is labeled as such. Sellers who receive payouts through ClearProp services may receive applicable U.S. tax forms (for example, Form 1099-K/NEC) when statutory thresholds are met; you are responsible for your own tax obligations.
Sanctions compliance: ClearProp screens accounts against government sanctions lists (OFAC SDN) at signup, at publishing, and at offers; listings involved in a sanctions hit are reviewed before transacting. Compliance with these lists is a condition of using ClearProp.
12. Prohibited use
You may not use ClearProp to: violate sanctions or export laws; launder money or structure payments to avoid reporting; sell stolen or lien-encumbered aircraft without disclosure; impersonate another person or business; scrape the marketplace for resale as data; or defraud buyers or sellers through off-platform payment demands (a practice we warn about directly, including in deal rooms).
Enforcement: listings and accounts violating these rules are removed, and where the law requires, reported to authorities. Moderation actions are logged internally.
13. Accessibility
ClearProp aims to conform to WCAG 2.2 Level AA across the website and the installable app: keyboard operability, screen-reader labels on controls and images, color-contrast-checked surfaces, no color-only information, and visible focus states. Found a barrier? Write accessibility@clearprop.imwirefree.com and we will fix it and respond within a week.
14. Governing law and disputes
These terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-law rules. Before filing suit, the parties agree to attempt good-faith resolution for 30 days — start by writing support@clearprop.imwirefree.com — then to non-binding mediation in Fulton County, Georgia, if unresolved. You and ClearProp each waive any right to a jury trial for claims arising out of these terms to the fullest extent permitted by law.
Severability: if any provision is unenforceable, the rest stays in force.
